UK Government launches new consultation on SEPs
On 15 July 2025, the UK Intellectual Property Office (UKIPO) began a consultation on standard essential patents (SEPs).
The consultation relates to a proposed specialist track to prove licence rates for SEP portfolios – something UK courts have previously handled in respect of setting global fair, reasonable, and non-discriminatory (FRAND) license rates – as well as requiring greater transparency of standard-related patent information to be provided by patentees. Other proposals include the use of pre-action protocols, SEP remedies, alternative dispute resolution (ADR) measures, and a review of the availability of standards-essentially determination solutions.
The aim is to close “knowledge and information gaps between SEP holders and implementers” and to reduce the number of disputes between the two. The consultation is open until 07 October 2025.
