UK ratifies UPC Agreement
The Minister for IP, Mr Sam Gyimah MP, has today announced that the UK has taken the positive step to ratify the Unified Patent Court Agreement (UPCA).
Only ratification by Germany is now required before the Unified Patent Court (UPC) and Unitary Patent (UP) system can come into effect. France – the other mandatory ratification for the system to start - has already ratified, along with Austria, Belgium, Bulgaria, Denmark, Estonia, Finland, Italy, Malta, Latvia, Lithuania, Luxembourg, the Netherlands, Portugal, and Sweden.
We now await the outcome of the German Federal Constitutional Court challenge, which is currently blocking German ratification, along with news on proposals for the long-term participation of the UK in the UPC and UP project after March 2019.
