Philips v ASUS & HTC: SEPs
In a series of judgments in Philips v ASUS & HTC, the English Patents Court has validated 2 out of 3 of Philips’ standard essential patents (SEPs), paving the way for a FRAND trial scheduled for 2019/2020.
This is one of a series of cases commenced following the English Patents Court handing down its FRAND decision in Unwired Planet v Huawei (others including Conversant v Huawei and Apple v Qualcomm). There the court determined the terms for a global FRAND licence which, if Huawei declined to accept, would result in an injunction being granted against it.
