Unified Patent Court Preparatory Committee signals state of readiness

The UPC Preparatory Committee met for the final time on 15 March 2017, and declared a state of readiness for the provisional application period to begin at the end of May. At that point the UPC becomes a legal entity that can operate and contract in its own right, enabling it to prepare for the scheduled opening of the court for business at the start of December 2017.

Consequently the sunrise period for opt outs is scheduled to begin in September 2017, allowing approximately three months for businesses to make any adjustments to their IP strategies.

The start of the provisional application period still depends on a small number of additional signatory states acceding to the protocol on provisional application, but the committee are confident that this will happen before the end of May.
