Galaxy Tab Does Not Infringe Apple's Design
On Monday 9 July, Judge Birss QC held that Samsung’s Galaxy Tab tablet did not infringe Apple’s Registered Community Design 000181697-0001
Although other Courts in the EU have decided upon certain aspects of this case, these issues, to date, have related to granting interim and interlocutory injunctions and other procedural aspects. In fact, this is the first substantive hearing in the EU of the issue of infringement of the Registered Community Design. This decision may have potential impact on proceedings elsewhere in the EU pursuant to Art. 28 of the Brussels Regulation. A full report on the decision will follow shortly
