EPO Publishes Appeal Decision Against Examining Division's Refusal of Amazon's 'One Click' Application for Lack of Novelty and Inventive Step

In the latest event of the Amazon 'one-click' saga, the EPO has just published a new appeal decision. The appeal was against a decision of the Examining Division to refuse the application for lack of novelty and inventive step. The Board of Appeal rejected all requests presented during the appeal procedure on the grounds of lack of inventive step and/or of non-patentable subject matter (business method and presentation of information).

The application under appeal was a divisional application from the original and much debated one-click patent application, which had been previously rejected by the EPO. A further divisional application is still pending at the EPO which suggests that we are likely to hear again about this saga in the future.
