Practice & Professional Experience
Kirk specialises in pharmaceutical patent work providing advice to a range of clients including multinational companies, SMEs and universities. His practice encompasses drafting, filing and prosecution of patent applications with a particular emphasis on the preparation of infringement and validity opinions and EPO opposition/appeal proceedings.
Kirk has successfully represented his clients at EPO opposition/appeal proceedings in relation to a number of leading pharmaceutical products such as Lipitor, Atacand (T 1750/07), Nexium, Foradil (T 1215/06), Benicar, Celebrex (T 0696/05), Rebetol and Klaricid (T 1772/06). In relation to several of these cases Kirk has also gained experience of co-ordinating strategy between EPO oppositions/appeal proceedings and corresponding litigation in other jurisdictions, across Europe and the US.
Kirk is also adept at IP due diligence, having supported successful funding rounds for a number of his SME clients, and product acquisitions for his multinational clients.
Prior to joining D Young & Co, Kirk worked as an in-house patent attorney at GlaxoSmithKline. In 2006 Kirk was seconded to the New York law firm Kenyon & Kenyon.
Qualifications
BSc (Hons) in Chemistry, University of Sussex.
PhD in Organic Chemistry, University of Southampton (Pfizer Organic Chemistry Prize).
Certificate in Intellectual Property Law, Queen Mary College, University of London.
LLM in Intellectual Property Litigation, Nottingham Law School.
European Patent Attorney 2001.
